1. Acceptable Use
All material presented on CharityVillage.com (the "Content") is the exclusive property of the Company or its Content suppliers or customers and is protected under both Canadian and foreign copyright and trademark laws. Content includes text, graphic elements, images, logos, button icons, audio files, video files, HTML code, XML code, and software.
You may view and download the Content solely for your personal, noncommercial use. You may not modify, reproduce, display, distribute or otherwise use the Content for any commercial purpose. You may not include said content in or with any product that you or any third party may create or distribute, including software or other digital products, or make available said content on any file server. Without limiting the generality of the foregoing, you may post Content to the web site on behalf of a registered charity, an incorporated or unincorporated nonprofit organization, a government department or agency, or a supplier of products and services that specifically serve the nonprofit sector. Fees apply to the posting of some types of Content, and you agree to expedite prompt payment, of said fees. Said Content may be posted either by use of automated forms on the web site or by written request, and includes:
(i) recruitment advertisements for paid, full-time, part-time, permanent, temporary, or contract positions, located anywhere in the world, in the nonprofit or government sectors.
(ii) requests for proposals (RFPs) related to the nonprofit sector.
(iii) invitations to volunteers for unpaid, full-time, part-time, or temporary volunteer opportunities in the Canadian nonprofit sector.
(iv) event announcements for fundraising events with the purpose of raising money for a Canadian nonprofit or charity, community events mounted by a Canadian nonprofit organization for its community's enjoyment, awards events that recognize the achievements of individuals and organizations in Canada's nonprofit sector, and professional development events that help to build the skills of people involved in Canada's nonprofit sector.
(v) advertisements of goods and services deemed to be of specific interest to prospective purchasers in the Canadian nonprofit and government sectors.
(vi) requests for, and offers of, surplus equipment and supplies, pro bono services, and other free goods and services having utility for nonprofit organizations.Without limiting the generality of the foregoing, you are specifically prohibited from posting Content to the web site:
(i) if the subject organization has not granted you authority to do so.
(ii) if the subject organization is not a registered charity, an incorporated or unincorporated nonprofit organization, a government department or agency, or a supplier of products and services that specifically serve the nonprofit sector.
(iii) if the subject organization is known to have engaged in racist or terrorist activity.
(iv) if it does not comply with the Canadian Human Rights Act or applicable provincial human rights legislation.
(v) if it seeks to recruit employees, volunteers, interns, representatives, agents, or other associates for any franchise, pyramid scheme, distributorship, multi-level marketing arrangement, sales agency arrangement or other business or employment opportunity which makes employment or consideration conditional upon the payment of any fee or the purchase of goods or services, with the sole exceptions described in the following paragraph (vi).
(vi) if it seeks to attract volunteers who must pay a training or participation fee, unless the amount of the training fee is clearly stated and the fee is payable only after the individual has been accepted to participate.
(vii) if it seeks to recruit a provider of personal services for an individual.
(viii) if it is misleading, illegal, untruthful, defamatory, obscene, threatening, abusive, hateful, seditious, or if it violates the property, personal or privacy rights of others.The Company does not warrant the quality, accuracy or completeness of any information on our web site. Such information is provided "as is" without warranty or condition of any kind. This web site may include inaccuracies or typographical errors. In no event will CharityVillage Ltd. be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available on this web site.
No endorsement of any third party products or services is expressed or implied by any information, material or content referred to or included on, or linked from or to this web site.
The Company acts as a passive conduit for the online distribution and publication of Content posted to the web site by users, and has no obligation to screen said Content in advance or review Content posted by users. These Terms and Conditions shall be interpreted, construed and governed by the laws in force in the Province of Ontario, without reference to its conflict of laws principles, except where prohibited by mandatory provisions of the laws applicable in your jurisdiction. Each party hereby agrees to submit to the jurisdiction of the courts of Ontario and to waive any objections based upon venue in any such action, suit or proceeding.
